Terms of Use and Service Provision
These Terms of Use and Service Provision (the “Terms”) govern the use of the AZMEMORIA.com website and the purchase of AZMEMORIA services, including the creation of digital memorial pages, production of QR plates and related services. For the purposes of these Terms, the said entity is hereinafter referred to as “AZMEMORIA”, “we”, “us” or the “Provider”. The service customer is hereinafter referred to as the “Customer”, “you” or the “Client”.
1. General Provisions
1.1. These Terms constitute a public offer in accordance with Article 395 of the Civil Code of the Republic of Azerbaijan. By placing an order on the Website, you accept the terms of this offer in full.
1.2. These Terms may be amended by the Provider unilaterally. The current version of the Terms is always available on the Website. Continued use of the Website and services after the publication of changes constitutes your acceptance of the new version of the Terms.
1.3. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in force.
1.4. The section headings of these Terms are provided for convenience only and do not affect the interpretation of the provisions.
2. Description of Services
2.1. AZMEMORIA provides services for the creation and maintenance of digital memorial pages dedicated to the memory of deceased persons.
2.2. The services include: creation of a memorial page with photographs, biography and life story; publication of the page on the Internet at a unique address; production and delivery of a physical QR plate for installation on a gravestone; provision of access to the page via a QR code.
2.3. The exact list of services, their scope and cost are indicated on the Website and in the order confirmation.
2.4. The Provider is entitled to engage third parties for the provision of individual services (plate production, delivery, hosting).
2.5. The Provider is entitled to change the functionality of the Website and the list of services, notifying the Customer via the Website or email.
3. Memorial Page
3.1. The memorial page is created on the basis of information and materials provided by the Customer.
3.2. The Customer independently determines the content of the page: photographs, texts, dates, biographical information.
3.3. The page is published at a unique address of the form azmemoria.com/name-surname.
3.4. Access to the page may be open (public) or restricted at the Customer's discretion.
3.5. The Customer receives access to page management (control panel) for making changes.
3.6. The Provider is entitled to place technical information and service links on the page.
3.7. The page must not contain information contrary to the legislation of the Republic of Azerbaijan.
4. Digital Storage Period and 10-Year Guarantee
4.1. The Provider guarantees the storage of the memorial page for 10 (ten) years from the moment the page is activated.
4.2. The storage guarantee means that the page will be available on the Internet at its address during the specified period, provided that the Customer complies with these Terms.
4.3. After the 10-year period expires, the Customer may extend the storage under new conditions published on the Website.
4.4. The storage guarantee does not apply where the page is removed at the Customer's request, by court decision, or due to the Customer's breach of these Terms.
4.5. The Provider takes reasonable measures to back up data, but does not guarantee the absence of technical failures.
4.6. In the event of the Provider ceasing its activities, it undertakes to notify Customers at least 60 days in advance and to provide the ability to export page data.
5. Guarantees on the Physical QR Plate
5.1. The physical QR plate is covered by a 10 (ten) year guarantee from the moment the plate is handed over to the Customer.
5.2. The guarantee covers the material from which the plate is made and the quality of the applied QR code.
5.3. The guarantee does not cover mechanical damage resulting from improper installation, vandalism, natural disasters or other external influences.
5.4. A warranty case is confirmed by photographs of the damaged plate sent by the Customer to the support address. The Provider is entitled to request the return of the damaged plate.
5.5. In the event of a warranty case, the Provider undertakes to produce and hand over a new plate to the Customer within no more than 30 days from the confirmation of the warranty case.
5.6. Delivery of the new plate is carried out at the Provider's expense.
6. Placement of the QR Code on the Gravestone
6.1. Installation of the QR plate on the gravestone is carried out by the Customer independently or with the involvement of specialised organisations.
6.2. The Provider does not provide gravestone installation services and is not responsible for the quality of installation.
6.3. Before installation, the Customer must ensure that the installation of the plate does not contradict cemetery rules and legislation.
6.4. The Provider provides installation recommendations together with the order.
6.5. The Provider is not responsible for damage to the plate during installation.
7. Placing an Order
7.1. An order is placed through the Website by filling in the order form and making payment.
7.2. After placing an order, the Customer receives a confirmation at the specified email address.
7.3. An order is deemed accepted from the moment the Provider receives payment in full.
7.4. The Customer undertakes to provide accurate data when placing an order.
7.5. The Provider is entitled to refuse to fulfil an order if the data provided does not allow the order to be fulfilled.
7.6. The Customer is responsible for the accuracy of the data provided, including the delivery address.
7.7. Changes to an order after payment are possible in agreement with the Provider.
8. Customer Obligations
8.1. The Customer undertakes to use the Website and services in accordance with these Terms and the legislation of the Republic of Azerbaijan.
8.2. The Customer undertakes to provide accurate information during registration and order placement.
8.3. The Customer undertakes not to transfer access to the page control panel to third parties.
8.4. The Customer undertakes not to use the Website to post illegal content.
8.5. The Customer undertakes not to take actions aimed at disrupting the operation of the Website.
8.6. The Customer undertakes not to copy or use Website materials for commercial purposes without the Provider's consent.
8.7. The Customer undertakes to pay for services in a timely manner in accordance with the selected tariff.
- The Customer is prohibited from posting content on the memorial page that violates the rights of third parties, including copyright.
- The Customer is prohibited from posting content containing calls to violence, extremism or discrimination.
- The Customer is prohibited from using the Website to distribute malicious software.
- The Customer is prohibited from impersonating another person when using the Website.
9. Customer's Authority Regarding the Deceased
9.1. The Customer confirms that he or she is a relative of the deceased or a person authorised by the relatives of the deceased to create the memorial page.
9.2. The Customer guarantees that the creation of the memorial page does not violate the rights and legitimate interests of other persons.
9.3. The Provider is entitled to request documents confirming the Customer's authority in the event of a dispute.
9.4. In the event of justified objections from the relatives of the deceased, the Provider is entitled to suspend access to the page until the dispute is resolved.
10. Responsibility for Content
10.1. The Customer bears full responsibility for the content of the memorial page, including the accuracy of the information posted.
10.2. The Provider does not verify the accuracy of information posted by the Customer.
10.3. The Provider is entitled to remove content that violates legislation or these Terms without prior notice.
10.4. The Customer undertakes to compensate the Provider for losses arising in connection with the posting of illegal content.
11. Copyright on Photographs and Other Materials
11.1. The Customer guarantees that he or she holds all necessary rights to the photographs and other materials posted on the memorial page.
11.2. By posting materials on the page, the Customer grants the Provider a non-exclusive licence to store, process and display them within the framework of service provision.
11.3. The Provider does not claim copyright on materials posted by the Customer.
11.4. At the Customer's request, materials may be removed from the page in accordance with Section 18 of these Terms.
- The Customer is not entitled to post photographs taken by professional photographers without the author's permission.
- The Customer is not entitled to post photographs depicting third parties without their consent.
- The Customer is not entitled to post materials obtained from closed sources.
12. Genealogy
12.1. The Website may provide the ability to maintain a family genealogical tree.
12.2. Information about family relationships is posted on the basis of data provided by the Customer.
12.3. The Customer is responsible for the accuracy of genealogical information.
12.4. The Provider does not conduct genealogical research and does not verify family relationships.
13. Grave Geolocation
13.1. The Website may provide the ability to specify the geolocation of the burial site.
13.2. The geolocation is specified by the Customer voluntarily.
13.3. The Provider does not guarantee the accuracy of the specified coordinates and is not responsible for errors in their determination.
14. Cost and Payment
14.1. The cost of services is indicated on the Website in manats (AZN) and includes all taxes.
14.2. Payment is made by bank transfer through the payment systems available on the Website.
14.3. The moment of payment is determined by the moment the funds are credited to the Provider's account.
14.4. The Provider is entitled to change the cost of services, while the cost of already paid orders does not change.
14.5. The Customer receives an electronic receipt or other payment document after payment.
15. Completion Time
15.1. The time for creating a memorial page is up to 5 (five) business days from the moment of payment.
15.2. The time for producing a QR plate is up to 10 (ten) business days from the moment the layout is confirmed.
15.3. The delivery time depends on the chosen delivery method and region.
15.4. The Provider is entitled to extend the completion time in the event of circumstances beyond its control, notifying the Customer.
16. Refunds and Order Cancellation
16.1. The Customer is entitled to cancel an order before the services begin.
16.2. When an order is cancelled before the services begin, the Provider refunds the payment in full.
16.3. When an order is cancelled after the services have begun, a refund is made in proportion to the volume of work completed.
16.4. Refunds are made to the account from which the payment was made within 10 (ten) business days.
16.5. Memorial page creation services are services performed to an individual order and are not subject to refund after completion.
17. Changing and Correcting the Page
17.1. The Customer is entitled to make changes to the memorial page through the control panel.
17.2. The initial filling of the page (up to 10 photographs and 1 biography) is included in the cost of the service.
17.3. Additional changes may be paid in accordance with the tariffs published on the Website.
17.4. The Provider is entitled to correct technical errors on the page without agreement with the Customer.
18. Memorial Removal
18.1. The Customer is entitled to remove the memorial page at any time through the control panel or by contacting support.
18.2. Removing the page is an irreversible action.
18.3. If the page is removed within 14 days of payment, the Provider refunds the payment in full.
18.4. If the page is removed after 14 days, no refund is made, except in cases provided for by legislation.
19. Suspension or Removal of Content
The Provider is entitled to suspend access to the page or remove content in the following cases:
- receipt of a reasoned request from government authorities;
- entry into force of a court decision;
- detection of content that violates legislation or these Terms;
- technical necessity to ensure the security of the Website.
20. Technical Maintenance
The Provider is entitled to carry out technical works that may temporarily restrict access to the Website. The Provider strives to carry out such works at night and to notify Customers in advance where possible.

- software updates;
- elimination of technical failures;
- security measures.
21. Limitation of Liability
21.1. The Provider is not liable for losses arising from the use of the Website, except in cases provided for by legislation.
21.2. The Provider is not liable for the content of information posted by the Customer and for the actions of third parties.
21.3. The Provider's aggregate liability for any order is limited to the amount paid by the Customer for that order.
- failures in the operation of the Internet and communication channels;
- actions of hackers and malicious software;
- unavailability of the Website for reasons beyond the Provider's control;
- losses arising from inaccurate data provided by the Customer.
22. Force Majeure
22.1. The parties are released from liability for non-performance of obligations if the non-performance is caused by force majeure circumstances: natural disasters, military actions, epidemics, changes in legislation and other circumstances that the parties could not foresee and prevent.
23. Changes to These Terms
23.1. The Provider is entitled to change these Terms unilaterally.
23.2. The new version of the Terms comes into force from the moment of its publication on the Website.
23.3. Continued use of the Website after the publication of the new version means the Customer's consent to the changes.
24. Applicable Law and Disputes
24.1. These Terms are governed by the legislation of the Republic of Azerbaijan.
24.2. All disputes and disagreements are resolved through negotiations.
24.3. If a dispute cannot be resolved through negotiations, the dispute is referred to the court of the Republic of Azerbaijan at the Provider's location.
24.4. The invalidity of any provision does not entail the invalidity of the remaining provisions.
Customer's Brief Confirmation
- I confirm that I am a relative of the deceased or a person authorised by the relatives of the deceased.
- I confirm that I hold all necessary rights to the photographs and materials posted on the memorial page.
- I confirm that I have read the data storage and personal data processing conditions.
- I confirm that I have read the guarantee conditions for digital storage and the physical plate.
- I confirm that I have read the payment, refund and order cancellation conditions.
- I confirm that the information provided is accurate.
- I accept the terms of this Agreement in full.
