Privacy Policy

This Privacy Policy (the “Policy”) defines the procedure for the processing and protection of personal data of users of the AZMEMORIA.com website (the “Website”) and AZMEMORIA services. For the purposes of this Policy, the said entity is hereinafter referred to as “AZMEMORIA”, “we”, “us” or the “Operator”. The user of the Website and services is hereinafter referred to as the “User”, “you” or the “Customer”.

1. General Provisions

1.1. This Policy has been developed in accordance with the Law of the Republic of Azerbaijan “On Personal Data” and other regulatory legal acts of the Republic of Azerbaijan.

1.2. By using the Website and services, you agree to the terms of this Policy.

1.3. This Policy may be amended by the Operator unilaterally. The current version of the Policy is always available on the Website.

1.4. If you do not agree with the terms of this Policy, you must stop using the Website and services.

2. Personal Data We Collect

2.1. The Operator collects the following personal data:

  • first name, last name, patronymic;
  • phone number;
  • email address;
  • delivery address;
  • data about the deceased provided by the Customer (first name, last name, dates of life, biography, photographs);
  • information about orders and payments;
  • technical data (IP address, device data, cookies).

3. Purposes of Personal Data Processing

3.1. The Operator processes personal data for the following purposes:

  • provision of services, including the creation and maintenance of memorial pages;
  • production and delivery of QR plates;
  • order processing and payment processing;
  • communication with the Customer regarding service provision;
  • improving the quality of the Website and services;
  • compliance with legal requirements.

4. Legal Grounds for Processing

4.1. Personal data processing is carried out on the basis of:

  • the User's consent to the processing of personal data;
  • a contract to which the User is a party;
  • the requirements of the legislation of the Republic of Azerbaijan;
  • the legitimate interests of the Operator.

5. Processing of Data on Deceased Persons

5.1. Data on deceased persons is provided to the Operator by the Customer voluntarily.

5.2. The Customer confirms that he or she is a relative of the deceased or a person authorised by the relatives of the deceased.

5.3. The Operator processes data on deceased persons solely for the purpose of providing services.

5.4. The Operator does not disclose data on deceased persons to third parties, except in cases provided for by legislation.

6. Storage of Personal Data

6.1. Personal data is stored for the period necessary to achieve the purposes of processing.

6.2. Memorial page data is stored for 10 (ten) years from the moment the page is activated.

6.3. After the storage periods expire, the data is deleted or anonymised.

6.4. The Operator takes organisational and technical measures to protect personal data from unauthorised access, alteration, disclosure or destruction.

7. Transfer of Personal Data to Third Parties

7.1. The Operator does not transfer personal data to third parties, except in the following cases:

  • transfer of data to persons involved in the provision of services (payment systems, delivery services, hosting providers);
  • at the request of government authorities in accordance with legislation;
  • by court decision;
  • with the User's consent.

8. Cookies and Technical Data

8.1. The Website uses cookies to ensure the operation of the Website and improve the user experience.

8.2. The User may disable cookies in the browser settings, however this may limit the functionality of the Website.

8.3. The Operator collects technical data (IP address, browser type, device data) to ensure security and analyse the operation of the Website.

  • request the clarification, amendment or deletion of his or her personal data;
  • withdraw consent to the processing of personal data;
  • request the termination of personal data processing;
  • appeal the Operator's actions to the authorised bodies.

10.1. The Operator takes the necessary legal, organisational and technical measures to protect personal data.

10.2. Only authorised employees of the Operator have access to personal data.

10.3. The Operator regularly assesses the effectiveness of the protection measures taken.

11. Validity of the Policy

11.1. This Policy is valid indefinitely until replaced by a new version.

11.2. The new version of the Policy comes into force from the moment of its publication on the Website.
